TikTok Shop Product Safety & Recall Policy

  1. Policy Principle

This policy is established in accordance with the Mexican Federal Consumer Protection Law, the Quality Infrastructure Law, applicable Mexican Official Standards, and regulations issued by PROFECO, COFEPRIS, SENASICA, and other competent authorities.
TikTok Shop is committed to ensuring that all products sold on the platform are safe and compliant.
The sale of recalled or unsafe products is strictly prohibited.
As permitted by applicable laws, you should bear all costs associated with recalls of your products. If TikTok Shop ends up bearing costs associated with recalls of your products, including but not limited to costs related to collecting products, actions from authorities, customer complaints, administrative proceedings, lawsuits etc., TikTok Shop may recoup such costs from you via any means, including by deducting from your funds, charging your payment methods or any other.
  1. What is a Product Recall?

A product recall is an action taken to remove a product from the market due to safety concerns, regulatory violations, or defects that may pose risks to consumers. A product recall can be initiated by different parties to protect the public from harm, including:
  • Regulatory authorities (e.g., COFEPRIS, PROFECO, SENASICA)
  • Manufacturers or brands
  • Sellers
⚠️ TikTok Shop may take action even if no official recall has been issued, based on internal safety assessments, complaints, or product-related incident reports.
  1. Safety Monitoring & Detection

TikTok Shop employs reasonable measures to monitor product safety, including but not limited to:
  • Customer complaints, reviews, and incident reports.
  • Regulatory recall databases and public alerts.
  • Manufacturer or seller notifications.
TikTok Shop's monitoring efforts are supplementary and do not replace the seller's obligation to ensure product safety and regulatory compliance under applicable laws.
  1. Scope of Enforcement

TikTok Shop may take action on:
  • Products officially recalled by manufacturers or sellers.
  • Products subject to regulatory safety or quality alerts.
  • Products identified as unsafe by the platform.
  • Products that share the same identified defect, hazardous component, manufacturing process flaw, or design deficiency as the recalled product.
This includes:
  • Re-listed or duplicated products.
  • Modified, rebranded, or bundled versions.
  • Products with similar structure, function, or risk profile.
  1. Platform Actions

Depending on the level of risk, TikTok Shop may:
  • Remove or suspend product listings
  • Freeze related inventory or restrict distribution
  • Notify sellers and request additional information
  • Notify affected customers when necessary
  • Report safety issues to relevant authorities
  1. Seller Obligations

If your product is affected by an official or safety-related recall, you must:
  1. Remove all related listings and ads within 24 hours of the notification.
  2. Do not proceed with any shipments of this product.
  3. Do not relist or advertise products affected by the recall or safety alert.
  4. Verify recall status through manufacturers or official recall sources
  5. Cooperate with TikTok Shop investigations and provide required documentation
  6. Take corrective actions in accordance with applicable laws and regulations.
  7. Seek independent legal advice as appropriate.
Failure to fulfill these responsibilities may lead to enforcement actions against you.
You may be responsible for product recall associated costs,
  1. Reinstatement Rules

  • If the product is confirmed as recalled or unsafe, it must not be relisted
  • If the product is not part of an official recall:
    • Sellers must provide valid supporting evidence to guarantee the safety issues have been resolved.
    • Products must meet all applicable compliance requirements before relisting
TikTok Shop reserves the right to review and make the final decision on reinstatement.
  1. Enforcement Actions

Violations of this policy may result in:
  • Listing removal or suspension
  • Product or inventory freeze
  • Account restrictions or penalties
Repeated or severe violations may lead to stricter enforcement actions, including account suspension.
  1. Appeals

  • If you believe an enforcement action was applied in error, you may submit an appeal through the TikTok Shop Seller Center, providing the necessary supporting evidence.
  • If your product is officially lifted from recall, you may also submit an appeal with valid proof (e.g., recall withdrawal notice or manufacturer confirmation).
TikTok Shop reserves the right to make the final decision on all appeals within the scope of its platform policies. Nothing in this policy limits or waives the seller's rights to seek remedies, file a complaint through applicable conciliation proceedings, or pursue any other legal remedies available under Mexican law.
